Welcome to Cloudrails. These Terms of Service ("Terms") govern your use of the Cloudrails platform, including our website and related services (the "Service").
Cloudrails is a software platform that allows surf shops and independent board hosts ("Shops") to display rental inventory and accept booking requests from users ("Renters"). Cloudrails does NOT process payments, act as a party to rentals, or handle disputes between users.
Cloudrails provides booking and inventory management tools only. All rental agreements, payments, deposits, and disputes occur directly between Shops and Renters.
Users may be required to create an account. You are responsible for maintaining accurate information and securing your account. Cloudrails may suspend or terminate accounts at its discretion.
Bookings made through Cloudrails represent a reservation request or confirmation between the Renter and the Shop. Cloudrails does not guarantee availability, fulfillment, or accuracy of listings.
All payments are handled directly by the Shop using their own payment methods (e.g., Stripe, PayPal, cash). Cloudrails does not collect or process payments and is not responsible for refunds, disputes, or chargebacks.

Users may upload content such as images and descriptions. You retain ownership but grant Cloudrails a license to display and use such content within the platform.

All interactions, rentals, and agreements occur directly between users. Cloudrails is not responsible for the actions, quality, safety, or legality of any user or listing.
The Service is provided "as is" without warranties of any kind. Cloudrails does not guarantee reliability, availability, or accuracy.
Cloudrails is not liable for any damages arising from use of the Service, including rental disputes, injuries, or losses.
You agree to indemnify and hold Cloudrails harmless from any claims arising from your use of the Service.
Cloudrails may suspend or terminate access at any time for violations of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the location of the rental provider, and venue shall also be a court within such location. However, if Cloudrails or any of its affiliated entities are a named party in a legal action involving these Terms, then these Terms shall be governed by and construed in accordance with the laws of the State of New York, and venue shall be any court located in New York City or Long Island.
Cloudrails may update these Terms at any time. Continued use constitutes acceptance.
If you register as a Shop or Host on Cloudrails, you agree to be bound by the Cloudrails Shop Agreement, which governs your use of the platform as a provider of rental inventory. In the event of any conflict between these Terms and the Shop Agreement, the Shop Agreement controls.

Cloudrails operates in compliance with the Digital Millennium Copyright Act (17 U.S.C. § 512) ("DMCA"). If you believe that content uploaded to Cloudrails infringes your copyright, please submit a valid DMCA takedown notice to info at cloudrails.org. Cloudrails reserves the right to terminate or suspend the accounts of users or shops that are found to be repeat infringers of third-party intellectual property rights.
